The Controller processing your personal data is FITJAM GLOBAL PLATFORM – FZCO, a company seated at: Dubai Silicon Oasis, Dubai, United Arab Emirates, License ID: 60391. The Controller processes personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the Protection of natural persons with regard to the processing of personal data and on the free movement of such data, and Act No. 18/2018 Coll. on Personal Data Protection and on the amendment of certain other Acts, as amended (Personal Data Protection Act).

Purposes and Scope of Personal Data Processing

The Controller processes the User's personal data:

  • For the purposes of establishing and management of the User Account, including the User's access data given in the registration form and used by the User in the User's Access Account in the Application in the following scope: name and surname, user name, telephone number, e-mail, date of birth, residential address, occupation, curriculum vitae, country,
  • For the purpose of providing services related to use of the Application by the User – saving audio, video or audio-visual records, photographs, music, texts, graphic and other materials added, made available, published or shared by the User in the Application,
  • For direct marketing related to the functionalities of the Application in the following scope: name, surname, e-mail address.

Legal Basis for Personal Data Processing

Establishing and management of the User Account and use of the application

Pursuant to Article 6, par. 1 b) data processing is necessary for fulfilment of the contract to which the person is a party.

Sending newsletters and other electronic marketing materials

Pursuant to Article 6, par. 1 f) data processing is necessary for legitimate interests pursued by the Controller or a third party.

Processing Activities

The Controller will process (including collection, recording, organization, structuring, saving, changes, retrieving, use, providing, combining, erasing and disposal) the User's personal data for the purpose of use and operation of the Application and in order to provide the User with the related technical support.

Term of Personal Data Processing

  • As a rule, your personal data is retained over the period of existence of our mutual contractual relationship and over the period of duration of the limitation of time referring to any of our or your related claims.
  • If required by applicable legal regulations, documents containing your personal data are retained for a defined period.
  • If your personal data is processed based on your consent, then the data is retained with us for not longer than 5 years, or until the withdrawal of your consent, if you withdraw your consent before the above-mentioned period.

Providing Personal Data or Making Personal Data Available

Your personal data is provided only in justified cases and to the extent necessary, to the following categories of recipients:

With respect to the above-mentioned facts, FITJAM GLOBAL PLATFORM – FZCO does not intend (except for the above-mentioned cases) to provide your personal data to third countries (non-EU countries).

Notification About the Rights of the Person Concerned

Right of access by the data subject

You can ask us for access to personal data processed about you. From the position of a Controller, we will provide you with a copy of the processed personal data.

Right to rectification

You can ask us for correction of incorrect or incomplete personal data processed about you.

Right to erasure

You can ask us to erase your personal data, if any of the following events occur:

  • Your personal data is no longer necessary for the purposes for which the data have been collected or otherwise processed;
  • You withdraw your consent, based on which your personal data have been processed, and there is no other legal basis for processing;
  • You have raised an objection against your being subject to decision-making based on automated processing of your personal data and there are no prevailing legitimate reasons for such processing, or you have raised an objection against the processing of your personal data for direct marketing purposes;
  • Your personal data were processed unlawfully;
  • Your personal data must be erased to comply with a legal obligation resulting from EU law or a member state's legislation applicable to the Controller;
  • Your personal data have been collected in relation to services offered by an information company.

Right to restriction of processing

You can ask the Controller to restrict the processing of your personal data should any of the following apply:

  • You denied the accuracy of your personal data, for a period necessary for the Controller to verify the accuracy of your personal data;
  • Processing of your personal data is unlawful, however, you oppose the erasure of the personal data and request the restriction of their use instead;
  • The Controller no longer needs the personal data for the purposes for which it was being processed, but you require it for the establishment, exercising or defence of legal claims;
  • You objected to processing pursuant to Art. 21 par. 1 of the EU Regulation, pending verification of whether the legitimate grounds of the controller override yours.

Right of data portability

In cases assumed by the EU Regulation, you have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format, provided that exercise of the right does not have a negative impact on the rights and freedoms of other persons.

Right to withdraw your consent

If your personal data is processed based on your consent, then you have the right to at any time withdraw your consent to the processing of your personal data for the purpose approved by you.

Right to object

You can at any time object against the processing of your personal data by us for the purposes of direct marketing based on our legitimate interest.

Right to complaint

You have the right to file a complaint to the supervising authority, which is the Office for Personal Data Protection of the Slovak Republic, Hraničná 12, 820 07 Bratislava 27, https://dataprotection.gov.sk/.

What Health and Fitness Data We Collect

FitJam collects and processes the following categories of health and fitness data to provide you with personalized workout plans, nutrition guidance, and wellness tracking:

Body Measurements and Physical Data

  • Height, weight, and body composition metrics
  • Age and gender
  • Fitness level assessment
  • Body measurements (if provided voluntarily)

Workout and Activity Data

  • Exercise history and workout completion records
  • Workout duration, intensity, and frequency
  • Sets, reps, and weights lifted
  • Activity streaks and consistency tracking
  • Exercise preferences and equipment availability

Nutrition and Diet Data

  • Meal photos and food intake records (when using AI meal scanner)
  • Calorie and macronutrient consumption
  • Dietary preferences, restrictions, and goals
  • Shopping list and meal plan selections

Wellness and Recovery Data

  • Mindfulness session completion
  • Recovery routine participation
  • Sleep patterns (if voluntarily provided)
  • Stress level indicators (if voluntarily provided)

Wearable Device Data (Optional Integration)

If you connect FitJam to wearable devices or health platforms (such as Apple Health, Google Fit, or other fitness trackers), we may access:

  • Heart rate and heart rate variability
  • Steps and distance traveled
  • Active minutes and calorie burn
  • Sleep duration and quality metrics
  • Blood oxygen levels (if available)
  • Respiratory rate (if available)

Important:Wearable integration is optional. You control which data types FitJam can access through your device's permission settings.

How We Collect Health Data

We collect health data through the following methods:

  1. Direct Input: Information you manually enter during onboarding and while using the app (goals, weight, fitness level, etc.)
  2. Automatic Tracking: Data generated from your activity within the app (completed workouts, streaks, exercise history)
  3. AI-Powered Features: Photos and scans you submit through our AI meal scanning feature
  4. Third-Party Integration: Data synced from connected wearable devices or health platforms (only with your explicit permission)
  5. Device Sensors: Limited access to device motion sensors for exercise tracking (only when actively using workout features)

Why We Collect Health Data (Purposes)

We collect and process your health data for the following legitimate purposes:

  1. Personalization and Service Delivery:
    • Generate customized workout plans based on your fitness level, goals, and available equipment
    • Create personalized meal plans matched to your caloric and nutritional needs
    • Adapt training difficulty and progression based on your performance
    • Provide exercise recommendations suitable for your body and capabilities
  2. Progress Tracking and Motivation:
    • Monitor your fitness journey and display progress over time
    • Calculate streaks, achievements, and milestones
    • Show trends in your body measurements, workout completion, and consistency
    • Send motivational reminders based on your activity patterns
  3. App Functionality and Features:
    • Enable AI meal scanning to analyze nutrition content
    • Sync data from wearable devices to provide comprehensive health insights
    • Generate shopping lists based on your meal plans
    • Provide recovery and mindfulness recommendations based on workout intensity

How We Use and Store Health Data

Storage and Security

  • All health data is encrypted in transit (using TLS/SSL) and at rest (using AES-256 encryption)
  • Health data is stored on secure cloud servers with restricted access
  • We implement industry-standard security measures including firewalls, access controls, and regular security audits
  • We retain your health data only as long as your account is active or as needed to provide services

Sharing of Health Data

WE DO NOT SELL YOUR HEALTH DATA TO THIRD PARTIES.

We may share your health data only in the following limited circumstances:

  1. With Your Consent:
    • If you explicitly choose to share your progress or achievements on social media
    • If you authorize integration with third-party health apps or services
  2. White-Label Partner Apps:
    • If you use a branded version of FitJam (e.g., FitJam by [Influencer Name]), your health data may be shared with that partner solely to provide personalized coaching and support
    • Partners are contractually required to protect your data and use it only for providing fitness services
  3. Service Providers:
    • Cloud hosting providers (for secure data storage)
    • Analytics services (only aggregated, anonymized data)
    • Payment processors (only transaction data, not health data)
    • These providers are bound by confidentiality and data protection agreements

Your Rights Regarding Health Data

You have the following rights concerning your health data:

  1. Access: You can view all health data we have collected about you at any time within the app settings.
  2. Export: You can download a copy of your health data in a portable format (JSON/CSV).
  3. Correction: You can update or correct any inaccurate health information in your profile settings.
  4. Deletion: You can delete your entire account and all associated health data by going to Settings → Account → Delete Profile in the app, or by contacting us at support@fitjam.app. Upon deletion, your health data will be permanently removed within 30 days.
  5. Withdraw Consent: You can revoke wearable device permissions at any time through your device settings, disable specific data collection features in app settings, or cancel your subscription.

Health Data Retention

  • Active Accounts: We retain your health data as long as your account is active
  • Deleted Accounts: Upon account deletion, all health data is permanently removed within 30 days
  • Backup Copies: Backup copies are purged within 90 days

Children's Health Data

FitJam is not intended for children under 13 years of age (or under 16 in the European Economic Area). We do not knowingly collect health data from children. If you are a parent or guardian and believe your child has provided us with health data, please contact us immediately at support@fitjam.app, and we will delete it promptly.

Health & Fitness Data (Health Connect & Apple Health)

FitJam integrates with Health Connect (Android) and Apple Health (iOS) to read health and fitness data that you explicitly choose to share with us. We access this data only after you grant permission, and only the data types listed below.

Data we access

With your permission, we read the following from Health Connect / Apple Health:

  • Steps
  • Active calories burned
  • Exercise / workout sessions
  • Resting heart rate
  • Heart rate variability (HRV)
  • Sleep (duration, stages, and efficiency)
  • Respiratory (breathing) rate

How we use this data

  • To display your metrics inside the app (activity, sleep, and recovery views).
  • To calculate a daily recovery score.
  • To personalize your workouts, meal guidance, and recovery recommendations.
  • To generate AI-powered written insights (see “Sharing” below).

Sharing with third parties

To generate AI insights, we send a summary of your daily metrics (steps, active calories, sleep duration and stages, resting heart rate, and HRV) to our backend, which forwards it to our AI provider, OpenAI, to produce a short personalized recommendation. No directly identifying information (such as your name or email) is sent together with this health data. We do NOT:

  • sell your health or fitness data, or share it with data brokers;
  • use it for advertising, including personalized or interest-based ads;
  • use it to determine credit-worthiness, insurance eligibility, or employment.

Storage, retention, and deletion

Health Connect / Apple Health data is read on your device on demand to power the features described above. When you request an AI insight, a summary of your daily metrics is sent to our backend and forwarded to OpenAI to generate the recommendation; this data is processed in memory only and is not stored on our servers — we do not retain your Health Connect / Apple Health data after your request has been served. The underlying data stays on your device under the control of Health Connect (Android) or Apple Health (iOS).

Your controls

You can review or revoke FitJam's access to your health data at any time:

  • Android: Settings → Health Connect → App permissions → Fit Jam
  • iOS: Settings → Health → Data Access & Devices → Fit Jam

Revoking access stops any further reading of your health data.

Health Connect Limited Use

Our access, use, and transfer of data obtained through Health Connect adhere to the Health Connect Permissions policy, including its Limited Use requirements. We only use Health Connect data to provide and improve the user-facing features described above, and we never transfer it for advertising or sale.

Exercise of Rights of the Person Concerned

The User can exercise his/her rights at any time:

  • In writing to the e-mail address: support@fitjam.app,
  • In writing to or in person at the registered office of FITJAM GLOBAL PLATFORM – FZCO.

Your rights can be exercised free of charge, unless legal regulations state otherwise.

Personal Data Security

  • Our application and other related systems are equipped with technical and organisational measures preventing access and changes to your data by unauthorised persons, and against loss and destruction of the data.
  • In our application, communication is encrypted, so that transfer of personal data is protected.
  • The safety of our platform is our priority and we are intensely committed to addressing data security issues.

Additional Declarations

If the User is below 16 years of age, it is hereby declared that the User asked his/her legal representative (parent) to give consent to the processing his/her personal data.

If the User provides the Controller with the personal data of a third person, the User declares on oath that he/she has available the written consent of the third party to provide the third party's personal data and can present it to the Controller upon request.

How to Delete Your FitJam Account

You can delete your FitJam account and all associated data directly in the app:

  1. Open the FitJam app
  2. Go to Profile → Settings
  3. Tap Delete Account
  4. Confirm the deletion

All your personal data, preferences, and progress will be permanently erased.

This action cannot be undone.
